ഭിന്നലൈംഗീകതയും ലൈംഗീകന്യൂനപക്ഷങ്ങളും: ഇസ്ലാമിക സമീപനം

മനുഷ്യൻറെ സാമൂഹിക ഇടപെടലുകളിലും പരസ്പരബന്ധങ്ങളിലും വിവിധ കാലഘട്ടങ്ങളിൽ മാറ്റങ്ങളുണ്ടാവുക സ്വാഭാവികമാണ്. പരസ്യമായി സംസാരിക്കാൻ മടിച്ചിരുന്ന പല വിഷയങ്ങളുമിന്ന് പൊതുചർച്ചകൾക്കും സാമൂഹ്യവിശകലനങ്ങൾക്കും വിധേയമായിക്കൊണ്ടിരിക്കുന്നു.അക്കൂട്ടത്തിൽ പെടുന്ന ഒന്നാണ് ഏറെ സങ്കീർണ്ണമായ ചർച്ചകൾക്കു വിഷയീഭവിച്ച  സ്വവർഗ്ഗ ലൈംഗീകതയും സ്വവർഗ്ഗാനുരാഗികളുടെ അവകാശങ്ങളും.  ആധുനിക കാലഘട്ടത്തിൽ  LGBTQ മൂവ്‌മെന്റിന്, അതിൻ്റെ  വക്താക്കളുടെയും  മനുഷ്യാവകാശ സംഘടനകളുടെയും ശ്രമഫലമായി സാമൂഹികസ്വീകാര്യത വർദ്ധിച്ചു വരുന്നതായി കാണാം. സാമൂഹികമായി നിലനിന്നിരുന്ന വിരോധങ്ങളും വിലക്കുകളും സാവകാശത്തിൽ നീങ്ങുകയും, ഇത് നിയമവിധേയമാവുകയും, ഇവർക്കു  നിയമ പരിരക്ഷ ലഭിച്ചുകൊണ്ടിരിക്കുകയും ചെയ്യുന്നു . എങ്കിലും, ആഴത്തിൽ വേരൂന്നിയിട്ടുള്ള ചില സാമൂഹിക ബോധങ്ങൾ LGBTQ മൂവ്‌മെന്റുകളെയും വ്യക്തികളെയും അംഗീകരിക്കുന്നതിൽ വിലങ്ങുതടിയായി നിൽക്കുന്നുണ്ട് എന്നതും വസ്തുതയാണ്. 

മുസ്‌ലിം ലോകത്തും ഇന്ന് ഏറെ ചർച്ച ചെയ്യപ്പെടുന്ന വിഷയമാണ് സ്വവർഗ്ഗ ലൈംഗീകതയും LGBT വിഭാഗങ്ങളും ക്വീർ പ്രസ്ഥാനങ്ങളും. മുസ്‌ലിം സമൂഹം വിശ്വാസപരമായി തന്നെ നിരാകരിക്കാൻ നിർബന്ധിതമായ ഒരു ജീവിതശൈലിയാണ് സ്വവർഗ ലൈംഗികതയെന്നു വലിയൊരു വിഭാഗം മനസ്സിലാക്കുന്നു.  ഈ വിഷയവുമായി ബന്ധപ്പെട്ടു ഉയർന്നുവരാറുള്ള സുപ്രധാന ചോദ്യം, ഇസ്‌ലാമിൽ ന്യൂനപക്ഷ ലൈംഗീകത, ഭിന്നലൈംഗീകത എന്നൊക്കെ വിശേഷിപ്പിക്കപ്പെടുന്ന സ്വവർഗ്ഗ ലൈംഗീകതയുടെ സ്ഥാനമെന്താണെന്നുള്ളതാണ്. ഒരേ ലിംഗത്തിൽ പെട്ട രണ്ടു വ്യക്തികൾ തമ്മിൽ ഉണ്ടാകുന്ന ആകർഷണം, ലൈംഗീകത, ന്യൂനപക്ഷ ലൈംഗീക സ്വത്വങ്ങൾ എന്നിവയുടെ ഇസ്‌ലാമിക മാനങ്ങൾ എന്നിവയും ചർച്ച ചെയ്യപ്പെടുന്നുണ്ട്. മുസ്‌ലിംസമുദായത്തിലെ ഒരു വിഭാഗം ലൈംഗീക വൈവിധ്യങ്ങളെ പരസ്യമായി പിന്തുണക്കുകയും, അവരുടെ അവകാശങ്ങൾക്കു വേണ്ടി തങ്ങൾ നിലകൊള്ളേണ്ടവരാണെന്നു വാദിച്ചു തുടങ്ങിയതിന്റെയും  ഫലമായാണ് ഈ ചോദ്യങ്ങൾ ഉടലെടുക്കുന്നത്.

ലൈംഗികത ഇസ്ലാമിക വീക്ഷണത്തിൽ

മനുഷ്യമനസിൻറെ ഇച്ഛകളെയുംതോന്നലുകളെയും ഒരു പ്രതലത്തിലും അവയുടെ കര്മാവിഷ്ക്കാരങ്ങളെ മറ്റൊരു പ്രതലത്തിലും നിർത്തിയാണ് ഇസ്‌ലാമിക നിയമങ്ങളുടെ പ്രതിനിധാനം.   മുസ്‌ലിം പണ്ഡിതന്മാരുടെ അഭിപ്രായത്തിൽ, വ്യക്തികൾ തമ്മിൽ ഉണ്ടാവുന്ന മാനസിക ആകർഷണങ്ങളും സ്നേഹങ്ങളും ശരീഅത്ത് വിഷയമാക്കുന്നില്ല. കാരണം,  മനസ്സിന്റെ ഇഷ്ടങ്ങളും ആകർഷണങ്ങളും വ്യക്തികളുടെ നിയന്ത്രണത്തിന് അതീതമാണ് എന്നുള്ളതുകൊണ്ടാണത്. മാത്രവുമല്ല, ഇത്തരം സ്നേഹാകർഷണങ്ങൾ ധാർമികബോധംകൊണ്ടും  വ്യക്തികളുടെ ആത്മശിക്ഷണത്തിന്റെയും ആത്മനിയന്ത്രണത്തിന്റെയും ഫലമായും നിയന്ത്രണവിധേയമാക്കാൻ പരിശ്രമിക്കാവുന്നതാണ്. എന്നാൽ കർമപഥത്തിൽ  ഇത്തരം  ആകർഷണങ്ങളും വികാരങ്ങളും ഉടലെടുക്കുമ്പോൾ അത് ശരീഅത്തിന്റെ പരിധിയിൽ വരും. ഇത്തരത്തിൽ ഒരേ ലിംഗവർഗ്ഗത്തിൽ പെട്ട മനുഷ്യർ തമ്മിലുള്ള ആകർഷണം തികച്ചും സ്വാഭാവികമായുണ്ടാവുന്ന ഒന്നാണെന്ന് വാദിക്കുന്നവർ പോലും മധ്യകാലഘട്ടത്തിൽ മുസ്‌ലിം പണ്ഡിതർക്കിടയിൽ ഉണ്ടായിട്ടുണ്ട്. എന്നാൽ ഇച്ഛകളല്ല കർമ്മങ്ങളാണ് ശരീഅത്തിന്റെ പരിധിയിൽ വരിക. ഒരു മനുഷ്യന്റെ പ്രകൃതം അധിക്ഷേപിക്കാവതല്ല, എന്നാൽ ആ പ്രകൃതത്തെ നിയന്ത്രണവിധേയമാക്കാതെ അതിനെ വന്യമായി വളരാൻ അനുവദിച്ചുകൊണ്ട്  അയാൾ ഏർപ്പെടുന്ന കർമ്മം അധിക്ഷേപാർഹമാകും എന്ന് ചിലർ വാദിക്കുന്നു.

വിവാഹേതര ലൈംഗീകബന്ധങ്ങൾ  ഇസ്‌ലാം കൃത്യമായും വ്യക്തമായും നിരോധിച്ചിരിക്കുന്നു. വിവാഹം സ്ത്രീയും പുരുഷനും തമ്മിലുള്ള ഉടമ്പടിയുടെ അടിസ്ഥാനത്തിൽ നിലനിൽക്കുന്ന ബന്ധമാണ്. വ്യക്തികൾ തമ്മിൽ ഈ കരാർ നിലനിൽക്കുന്നേടത്തോളം വിവാഹബാഹ്യ ലൈംഗീക ബന്ധം അനുവദനീയമല്ല എന്ന് മാത്രമല്ല, ശാരീരിക ബന്ധത്തിന് വിവാഹഉടമ്പടി ശരീഅത് നിർബന്ധമാക്കിയിട്ടുമുണ്ട്. വ്യഭിചാരവും മറ്റും ഇസ്ലാമില്‍ ഏറ്റവും വലിയ ധാര്‍മിക ദൂഷ്യമാണ്.

എന്നാൽ വ്യക്തികളുടെ സ്വകാര്യജീവിതത്തിലേക്കു എത്തിനോക്കുന്നതിനെ ശരീഅത് പ്രോത്സാഹിപ്പിക്കുന്നില്ല, എന്നുമാത്രമല്ല, വിവാഹബാഹ്യ ലൈംഗീകത സംബന്ധിച്ചു നാല് ആളുകൾ നേരിട്ട് കാണുക എന്ന തികച്ചും അസംഭവ്യമായ ഒന്നാണ് ശിക്ഷിക്കപ്പെടാനുള്ള മാനദണ്ഡമായി നിശ്ചയിച്ചിരിക്കുന്നത്. സമൂഹത്തിൽ മ്ലേച്ഛതയുടെ വ്യാപനം തടയുക എന്നതാണ് ഇതുമൂലം ശരീഅത് ലക്‌ഷ്യം വെക്കുന്നത് എന്ന് വ്യക്തമാണ്. സ്വവർഗ്ഗ ലൈംഗീകതയും ഇതുപോലെ വ്യക്തമായ രീതിയിൽ നിരോധിച്ച ഒന്നാണ്.

ഖുർആൻ വളരെ നിശിതമായി വിമർശിക്കുന്ന ലൂത്തിന്റെ ജനത സ്വവർഗ ലൈംഗീകതയിൽ ഏർപ്പെട്ടിരുന്ന ജനതയായിരുന്നു. അംഗീകൃതമായ ഒരു സാമൂഹികസംസ്‌കാരമായി ആ ജനതയിൽ സ്വവർഗരതി നിലനിന്നിരുന്നു.  സ്വന്തം പെൺമക്കളെ ചൂണ്ടിക്കാണിച്ചു ഇവരാണ് നിങ്ങളുടെ ശരിയായ ലൈംഗീക പങ്കാളികൾ എന്ന് പ്രവാചകൻ ലൂത് നബി   പ്രഖ്യാപിക്കുമ്പോൾ, അത് ഖുർആന്റെ നിർദ്ദേശം കൂടെയായി അംഗീകരിക്കപ്പെടുന്നു. വ്യക്തമായുള്ള Heterosexual നിയാമകമാണ് ഖുർആൻ മുന്നോട്ടു വെക്കുന്നത് എന്ന് കാണാം. അതുപോലെ സ്ത്രീ-പുരുഷദ്വന്ദം എന്നതിനപ്പുറത്ത് ഒരു മൂന്നാം ലിംഗ വിഭാഗത്തെ ഖുർആൻ പരാമർശിക്കുന്നുമില്ല. ലൈംഗീക ന്യൂനപക്ഷങ്ങളിൽ സ്ത്രീശരീരത്തിൽ പെട്ടുപോയ പുരുഷനായാലും, പുരുഷ ശരീരത്തിൽ അകപ്പെട്ട സ്ത്രീ ആയാലും, അവർ സ്വയം നിർണയിക്കുന്ന ലിംഗസ്വത്വം, ഒന്നുകിൽ സ്ത്രീയുടേത്, അല്ലെങ്കിൽ പുരുഷന്റേത് ആവും എന്നതുകൊണ്ടാവാമിത്‌. ഇതിൽനിന്ന് മാറി ഒരു മൂന്നാംലിംഗം അഥവാ  ഇന്റർസെക്സ് പേഴ്സൺസ് (Inter-sex Persons)  അത്യപൂർവ്വവും ആണ്.

ഗേ റൈറ്റ്സും മുസ്ലിംകളും

ഇസ്ലാം വ്യക്തമായി നിരോധിച്ച ഒരു വിഷയത്തെ മനുഷ്യാവകാശങ്ങളുടെ പേരിൽ മുസ്‌ലിംകൾക്കു പിന്തുണക്കാൻ സാധിക്കുമോ എന്നതാണ് മറ്റൊരു പ്രധാന ചോദ്യം. ഇത്തരത്തിൽ സ്വവർഗ്ഗ ലൈംഗീകതയിലേർപ്പെടുന്ന വ്യക്തികളുടെ അങ്ങിനെ ജീവിക്കാനുള്ള മനുഷ്യാവകാശത്തിന് വേണ്ടിയുള്ള പോരാട്ടത്തിൽ മുസ്‌ലിം പ്രതിനിധാനം എത്തരത്തിലുള്ളതാവണം എന്നത് വളരെ ഗൗരവത്തോടെ കൈകാര്യം ചെയ്യേണ്ടുന്ന വിഷയമാണ്.  സ്വവർഗ്ഗ ലൈംഗീകതയുടെ പല മാനങ്ങൾ ഈ വിഷയത്തിൽ പഠനമർഹിക്കുന്നു.

മാനസികമോ ശാരീരികമോ ആയ ഒരു രോഗാവസ്ഥയാണ് ഇത്തരം ലൈംഗീകവൃത്തി സ്വീകരിക്കുന്നവരെ അതിനു പ്രേരിപ്പിക്കുന്നതെങ്കിൽ, അത് ചികിൽസിച്ചു ഭേദമാക്കുക എന്നതാണ് ശെരിയായ രീതി. ചികില്‍സയിലൂടെ പ്രതിവിധി കണ്ടെത്താന്‍ പറ്റുന്നവയെ മാത്രമേ ഇവിടെ രോഗം എന്ന് വിവക്ഷിക്കുന്നുള്ളൂ. ഹോര്‍മോണ്‍ തകരാറുകളായാലും മാനസികപ്രശ്‌നങ്ങളായാലും ശാസ്ത്രീയമായ പ്രതിവിധി സാധ്യമാണെങ്കില്‍ അത് രോഗമായിത്തന്നെയാണ് ഗണിക്കപ്പെടേണ്ടതും പരിഹാരം കണ്ടെത്തേണ്ടതും. അതാണ് അവരോടു ചെയ്യേണ്ടുന്ന ഏറ്റവും മനുഷ്യത്വപരമായ നിലപാട്.

ഒരു രോഗാവസ്ഥ എന്നതിലുപരി പ്രകൃതിപരമായി  തന്നെ ഭിന്ന ലൈംഗീകത പ്രകടമാക്കുന്ന വിഭാഗമുണ്ട്. ട്രാൻസ് ജെൻഡറുകൾ എന്ന് വിശേഷിപ്പിക്കപ്പെടുന്ന ഇവരുടെ അഭിനിവേശങ്ങളെയും താല്‍പര്യങ്ങളെയും കേവലം അധാര്‍മികം എന്ന് മുദ്രകുത്താനാവില്ല. ഇവര്‍ അനുഭവിക്കുന്ന മാനസികവും വൈകാരികവുമായ പ്രശ്‌നങ്ങളെ അവഗണിക്കുക സാധ്യമല്ല.

ട്രാൻസ്ജൻഡർ വിഭാഗത്തിൽ പെടുന്ന,  യഥാർത്ഥത്തിൽ പ്രശ്നങ്ങൾ അനുഭവിക്കുന്നവർ തങ്ങളുടെ അവസ്ഥ നേരെയാക്കാൻ ലിംഗമാറ്റ ശസ്ത്രക്രിയ പോലുള്ളവ സ്വീകരിക്കാനുള്ള കാരണം, അവർ അവരുടെ സ്ത്രീ അല്ലെങ്കിൽ പുരുഷ വ്യക്തിത്വത്തെ തിരിച്ചറിയുന്നു എന്നതുകൊണ്ടാണ് എന്ന വസ്തുത അത്യധികം ശ്രദ്ധയർഹിക്കുന്നു. ഇവരുടെ അവകാശങ്ങളും പോരാട്ടങ്ങളും മനുഷ്യാവകാശപ്രവർത്തകരുടെയും പൊതുസമൂഹത്തിന്റെയും പിന്തുണയർഹിക്കുന്നു എന്നത് നിസ്തർക്കമാണ്.

ഫിക്സേഷൻ സംഭവിച്ചു പോയ ഹോമോസെക്ഷ്വലുകളോട് അനുഭാവപൂർണമായ നിലപാടെടുക്കാൻ സമൂഹം ബാധ്യസ്ഥരാണ്. അവരെ മാനസികമായും ശാരീരികമായുമൊക്കെ പീഡിപ്പിക്കുകയും ഒറ്റപ്പെടുത്തുകയും ചെയ്യുക എന്നതൊന്നും അംഗീകരിക്കപ്പെടേണ്ടതില്ല. അവരുടെ അവസ്ഥകൾ നേരെയാക്കാനുള്ള മാനസികവും സാമ്പത്തികവും സാമൂഹികവുമായ പിന്തുണ അവർക്കു ലഭിക്കേണ്ടതുണ്ട്.

ഉദാരലൈംഗികതയുടെ ശാസ്ത്രം

സെക്ഷ്വൽ Orientation ഫിക്സേറ്റഡ് ആയാൽ മാറ്റാൻ സാധിക്കില്ലെന്ന വാദം പാശ്ചാത്യൻ ഉദാരലൈംഗീകവാദികളുടേതാണ്. ഇതിനെ പലരും ഇന്ന് ചോദ്യംചെയ്യുന്നുണ്ട്. എന്നാൽ, ഇവരുടെ മറപറ്റി തഴച്ചുവളരാൻ ശ്രമിക്കുന്ന ലൈംഗീകഅരാജകത്വങ്ങളിലും സ്വതന്ത്ര ലൈംഗീകതയിലും ഊന്നിയ സ്വവർഗ്ഗ ലൈംഗീകതയെ പിന്തുണക്കാൻ ഇസ്‌ലാം അനുവദിക്കുന്നില്ല എന്നതാണ് യാഥാർഥ്യം.

ഇവർ പ്രകൃതിയെയും ശാസ്ത്രത്തെയും കൂട്ടുപിടിച്ചു തങ്ങളുടെ ലൈംഗീക വൈകൃതങ്ങൾക്കു ന്യായവാദങ്ങൾ ഉണ്ടാക്കുന്നു. പ്രകൃതി വൈവിധ്യങ്ങളും വൈജാത്യങ്ങളും  ഉള്‍ക്കൊള്ളുന്ന ഒരു മഴവില്‍ ലോകമാണ് എന്നും ഇതര ജീവജാലങ്ങളിലും മനുഷ്യരിൽ എന്നപോലെ സ്വവർഗലൈംഗീകത സർവസാധാരണമാണ് എന്നും ഇവർ വാദിക്കുന്നു. ഹോമോസെക്ഷുവാലിറ്റിക്കു കാരണമാകുന്ന ജനിതകഘടകങ്ങൾ ഇവരിൽ ഉണ്ടെന്നാണ് പറയപ്പെടുന്നത്. 1993 ൽ ജനിറ്റിസിസ്റ്റ് ഡീൻ ഹാമറും സഹപ്രവർത്തകരും കണ്ടുപിടിച്ച XQ28 ക്രോമോസോം ഭാഗമാണ് സ്വവർഗ്ഗലൈംഗീകതയ്ക്കു കാരണമാകുന്നത് എന്ന് അനുമാനിക്കപ്പെടുന്നുണ്ടെങ്കിലും, ഇത് അസന്ദിഗ്ധമായി തെളിയിക്കപ്പെട്ടിട്ടില്ല. ഇന്നും ശാസ്ത്രലോകത്ത്  ഗവേഷണം നടക്കുന്ന വിഷയമാണിത്. അതേസമയം, അതിനെതിരായുള്ള പഠനങ്ങളും വളരെയധികമുണ്ട്. ഇത്തരത്തിൽ ഏതെങ്കിലുമൊരു ജനിതകതകരാറോ പ്രത്യേകതയോ മൂലമാണ് സ്വവർഗ്ഗത്തിൽ പെട്ടയാളോട് ലൈംഗീകമായ ആകർഷണം ഉണ്ടാവുന്നത് എന്ന പഠനത്തെ നിരാകരിക്കുന്ന ഒന്നാണ് ആസ്ട്രേലിയയിലെ യൂണിവേഴ്സിറ്റി ഓഫ് ക്വീൻസ് ലാൻഡിലെ ഗവേഷകനായ ബ്രെണ്ടൻ  സീറ്റ്സച് (Brendan Zietsch) ഉം സംഘവും കണ്ടെത്തിയത്. തങ്ങളുടെ ജീവിതചുറ്റുപാടിൽ നിന്ന് ആർജ്ജിച്ചെടുക്കുന്ന അവസ്ഥയായാണ് ഇവരിതിനെ കാണുന്നത്. പഠനങ്ങൾ പുരോഗമിക്കുന്ന ഒരു മേഖലയാണിത്.

ജനിതക വൈവിധ്യം മൂലമുണ്ടാകുന്ന ഒന്നാണ് ഹോമോ സെക്ഷുവാലിറ്റി എന്ന വാദം വികൃതവും സാമൂഹികവിരുദ്ധവുമായ ആസക്തികളെപ്പോലും ന്യായീകരിക്കാന്‍ പര്യാപ്തമാണ്. കുഞ്ഞുങ്ങളുടെ മേൽ നടത്തുന്ന ലൈംഗീകാതിക്രമങ്ങളും (പീഡോഫീലിയ) ശവശരീരത്തെ ലൈംഗീകമായി ചൂഷണം ചെയ്യുന്ന നെക്രോഫീലിയ പോലുള്ളവയൊക്കെ ഇത്തരത്തിൽ ന്യായീകരിക്കപ്പെടുകയും സാമൂഹികസ്വീകാര്യത നേടിയെടുക്കുകയും ചെയ്‌താൽ  അത് ദുരന്തപൂര്ണമായ പ്രത്യാഘാതങ്ങൾ ഉണ്ടാക്കുമെന്നത് നിസ്തർക്കമാണ്.

അധാർമിക അവകാശങ്ങളോടുള്ള ഇസ്ലാമിക സമീപനം

മുസ്ലിംസമുദായത്തിലെ ആധുനികരും സ്വത്വരാഷ്ട്രീയക്കാരുമൊക്കെ ജെനുവിൻ ആയ ഇന്റർസെക്സ്, ട്രാൻസ് സെക്സ് വിഭാഗങ്ങളുടെ  മാത്രമല്ലാതെ ഉദാരലൈംഗീകവാദികളുടെയും സ്വവർഗാനുരാഗികളുടെയുമൊക്കെ സ്വതന്ത്ര ലൈംഗികതയുമായ് ബന്ധപ്പെട്ട അവകാശ വിഷയത്തിൽ ഏകോപിക്കുക എന്നത് ഇസ്ലാം മുന്നോട്ടു വെക്കുന്ന ധാർമ്മികതക്ക് എതിരാണ്. ഏതെങ്കിലും തരത്തിലുള്ള സ്വതന്ത്ര ലൈംഗീകത ഇസ്‌ലാം കണിശമായി തന്നെ നിരോധിച്ചിരിക്കുന്നു. കൂടാതെ സമൂഹത്തിൽ നിലനിൽക്കുന്ന ഒരു തിന്മയുടെ അവസ്ഥ നേരെയാക്കുന്നതിനു പകരം അതിനോട് രാജിയാവുക എന്നത് ഇസ്‌ലാം അംഗീകരിക്കുന്നില്ല. തെളിയിക്കപ്പെടാത്ത ജനിതകന്യായങ്ങളേക്കാൾ സാമൂഹിക / സാംസ്കാരിക  പരിണാമമാണ് സ്വവർഗലൈംഗീകതയ്ക് അടിസ്ഥാനമായി നിലനിൽക്കുന്നത് എന്നതുകൊണ്ട് പരിഹാരം അന്വേഷിക്കേണ്ടത്  മറ്റൊരു തലത്തിലാണ്.
